Terms & Conditions

StayByHours (“StayByHours”, “the Platform”, “we”, “us”) is an online platform for booking hotel rooms on an hourly and short-stay basis in India, operated by Straight Drive ITC Private Limited. By accessing or using the Platform — including creating an account, searching, or making a booking — you agree to be bound by these Terms & Conditions and our Privacy Policy. If you do not agree, please do not use the Platform.

• “Guest” / “you” — the person making or attempting a booking, or on whose behalf a booking is made.
• “Hotel Partner” — the accommodation provider listed on the Platform that supplies the room and related services.
• “Booking” — a confirmed reservation of a room for a specific time slot (hourly or longer).
• “Service” — the Platform’s facilitation of search, booking, payment, and support between Guests and Hotel Partners.

StayByHours acts as an intermediary between Guests and Hotel Partners. When you make a Booking, a contract for the accommodation itself is formed between you and the Hotel Partner; StayByHours facilitates the reservation and payment. Information on listings (photos, amenities, descriptions) is provided by Hotel Partners, and while we verify our partners, we cannot guarantee every detail is complete or error-free at all times.

• You must be 18 years or older to create an account or make a Booking.
• Sign-in and account creation use your email address with a one-time verification code; supported social sign-in providers may also be offered.
• You are responsible for keeping access to your email account (and any linked sign-in method) secure, and for all activity under your StayByHours account.
• Verification codes are personal to you — never share them. StayByHours will never ask you for a verification code.
• We may suspend or terminate accounts used fraudulently or in breach of these Terms.

• All Bookings are subject to availability at the Hotel Partner.
• Prices are shown per booking slot and exclude GST. Applicable GST is calculated separately and shown on the booking screen before payment.
• Payment must be completed at the time of booking through our secure payment gateway.
• A booking confirmation with your check-in and check-out times is sent by email and/or SMS after successful payment.
• Obvious pricing errors do not bind StayByHours or the Hotel Partner; affected bookings will be refunded in full.

• Free cancellation is available up to 2 hours before the scheduled check-in time.
• Cancellations within 2 hours of check-in receive a 50% refund.
• No-shows are not eligible for a refund.
• Refunds are processed within 5–7 business days to the original payment method.
• Where a Hotel Partner cannot honour a confirmed Booking, we will offer an alternative or a full refund.

• Check-in and check-out times are as stated in your booking confirmation; late check-out is charged at the applicable hourly rate and early check-in is subject to availability.
• A valid government-issued photo ID is required at check-in for every adult guest, as required by Indian law.
• Guests must comply with the Hotel Partner’s house rules and applicable law; unlawful, unsafe, or abusive behaviour may result in refusal of service without refund.
• Damage to hotel property may be charged to the Guest by the Hotel Partner.

You agree not to misuse the Platform — including scraping or copying content at scale, attempting to bypass security or rate limits, making fraudulent or speculative bookings, submitting false reviews, or infringing the rights of others. We may restrict access where misuse is detected.

Reviews you submit must reflect a genuine stay and must not contain unlawful, abusive, or defamatory content. By submitting content you grant StayByHours a non-exclusive licence to display it on the Platform. We may moderate or remove content that breaches these Terms.

The Platform, its branding, software, and content (other than Hotel Partner and Guest content) are the property of Straight Drive ITC Private Limited or its licensors. No rights are granted except the limited right to use the Platform for personal, non-commercial bookings.

Our collection and use of personal data — including account, booking, and identity-verification data — is described in the Privacy Policy, which forms part of these Terms.

StayByHours facilitates bookings and is not the provider of the accommodation. To the extent permitted by law, we are not liable for the acts or omissions of Hotel Partners or for indirect or consequential losses. Nothing in these Terms limits liability that cannot be limited under applicable law. Our aggregate liability in connection with a Booking is limited to the amount paid for that Booking. Disputes about the stay itself should be raised with the Hotel Partner or through our support team.

Neither StayByHours nor the Hotel Partner is responsible for failures caused by events beyond reasonable control, including natural disasters, government action, or utility and network outages.

We may update these Terms from time to time. The version published on this page at the time of your booking applies to that booking. Material changes will be signposted on the Platform.

These Terms are governed by the laws of India. Subject to applicable consumer protection law, the courts of India have jurisdiction over disputes arising from these Terms or the use of the Platform.
